Terms of Service

1. Acceptance of Terms

By accessing or using Orbit, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using Orbit on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Responsibilities

To use Orbit, you must create an account. When doing so, you agree to:

• · Be at least 13 years of age (users under 13 are not permitted to use the App)
• · Maintain the security of your account credentials
• · Notify us immediately of any unauthorized use of your account

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that contain false or misleading information.

3. Acceptable Use

Orbit is designed to foster genuine human connection. You agree not to use the App to:

• · Harass, bully, threaten, or intimidate other users
• · Post hate speech, discriminatory content, or content that promotes violence
• · Distribute spam, unsolicited advertising, or promotional material
• · Impersonate another person or misrepresent your identity
• · Share sexually explicit, obscene, or otherwise objectionable content
• · Attempt to gain unauthorized access to other users' accounts or our systems
• · Use automated scripts, bots, or other means to access or interact with the App
• · Engage in any activity that violates applicable laws or regulations

Violations of this section may result in content removal, account suspension, or permanent termination at our sole discretion.

4. Content Ownership and License

You retain ownership of all content you create and share on Orbit, including posts, emotions, questions, answers, and messages ("User Content"). By posting User Content, you grant Orbit a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the App.

You represent that you have the right to share any content you post and that your content does not infringe the intellectual property rights of any third party.

5. Content Moderation

We reserve the right, but are not obligated, to monitor, review, and moderate User Content. We may hide, remove, or restrict access to any content that violates these Terms or our community guidelines, at our sole discretion and without prior notice.

Orbit employs a comment moderation system that may automatically filter content based on community reports and algorithmic detection. If your content is moderated, you may appeal through the in-app reporting system.

6. Location Data Consent

Orbit is a location-based service. By using the App, you consent to the collection and use of your location data as described in our Privacy Policy. Location data is essential to the core functionality of the App, including connecting you with nearby users. You may disable location services at any time through your device settings, but doing so will limit the functionality of the App.

7. Disclaimer of Warranties

Orbit is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error free, secure, or free of harmful components. We do not guarantee the accuracy, completeness, or reliability of any content posted by users.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Orbit and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Orbit and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your User Content, or your violation of these Terms.

10. Termination

We may suspend or terminate your account and access to the App at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users or the App, or is otherwise objectionable. You may delete your account at any time through the Settings screen.

Upon termination, your right to use the App ceases immediately. Any provisions of these Terms that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the App or by other appropriate means. Your continued use of Orbit after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App and delete your account.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada and the applicable province in which Orbit operates, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Canada.
